Please read these terms before placing an order through the website.
These Terms and Conditions apply when you visit www.modelcarsforafrica.co.za, create an account, contact us or buy goods from Model Cars for Africa. By placing an order, you agree to these terms.
These terms must be read with our Privacy Policy and any product-specific information shown on the website. Nothing in these terms removes or limits a right that cannot lawfully be removed under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002 or another applicable South African law.

You must be at least 18 years old and legally able to enter into a contract. If you are under 18, a parent or legal guardian must place or approve the order and accept responsibility for it.
You must provide complete and accurate contact, billing and delivery information. You are responsible for keeping your account details and password secure.
We sell scale model cars and related collector products. A product may be new, pre-owned, vintage, boxed or unboxed. The product page will state the known condition and included packaging or accessories.
Many products are collector display models and are not toys. Follow the manufacturer’s age grading, safety information and packaging instructions. Small parts may be present.
The model brand, vehicle manufacturer, model, scale, colour, material, features and licensing status will be stated only where confirmed. Product packaging and manufacturer information take priority if a listing contains an obvious data-entry error.
We aim to show each product accurately. Screen settings, lighting and photography may make a colour look slightly different. Measurements described as approximate are estimates.
For pre-owned or vintage products, listing photographs may form part of the condition description. Any known box wear, missing parts, marks or other material condition issues will be disclosed on the product page.
Prices are shown in South African rand. Prices include applicable taxes unless the website clearly states otherwise. Delivery charges and any other order costs will be shown before you place the order.
Prices and stock may change without notice before an order is accepted. If a price, product description or stock quantity contains an obvious error, we will contact you before fulfilment. You may accept the corrected order or cancel for a full refund.
We may refuse or cancel an order where stock is unavailable, payment is not authorised, the order appears fraudulent, delivery is not possible, a product or price contains an obvious error, or the law requires us to do so.
Online payments are processed through PayFast by Network or another payment method shown at checkout. The payment provider may apply its own terms and privacy rules.
We do not receive or store your complete card number, card security code or online-banking password. Payment providers and financial institutions process these details through their systems.
An order will not be released until payment has cleared, unless we have agreed otherwise in writing.
Delivery is available to addresses supported by the delivery methods shown at checkout. The available delivery methods, delivery charge and estimated delivery period will be shown at checkout or confirmed before fulfilment.
Delivery dates are estimates unless we expressly agree to a fixed date. We remain responsible for the goods until they are delivered to you or a person authorised to receive them at the delivery address.
You must provide a complete delivery address and a contact number. We are not responsible for a delay caused by incorrect information, an unavailable recipient or an event outside our reasonable control. Any extra courier cost caused by incorrect information may be charged where the law permits.
If we cannot execute an order within 30 days, or within another period agreed with you, the rights and remedies in the Electronic Communications and Transactions Act apply.
Customer collection is available by appointment from 30 Sonskyn Road, Sunward Park, Boksburg, 1460. Wait for written confirmation that your order is ready before travelling to collect it.
We may ask for the order number and proof of identity. A person collecting on your behalf may need written authorisation.
Contact sales@modelcarsforafrica.co.za as soon as possible if you want to cancel or change an order. If the goods have not been dispatched, we will try to stop the order and refund the payment.
If the order has already been dispatched, the return rules below apply. Courier charges already incurred may be deducted only where the law allows.
Where section 44 of the Electronic Communications and Transactions Act applies, you may cancel an online purchase of goods without giving a reason within seven days after receiving the goods.
Please return the product with its original packaging, accessories and documentation where reasonably possible. You may inspect the product, but you must take reasonable care of it. Any deduction for loss in value will be made only where the law allows.
Inspect the parcel as soon as reasonably possible. If the item is incorrect, damaged in transit, incomplete or defective, contact us at sales@modelcarsforafrica.co.za and provide the order number, a description and clear photographs where available.
Prompt notice helps us investigate courier damage, but it does not remove a statutory consumer right.
Under the Consumer Protection Act, goods must meet the applicable standards of quality and suitability. Where section 56 applies, a consumer may return goods that fail those standards within six months after delivery and choose a repair, replacement or refund, subject to the Act.
We will carry the reasonable return cost for goods correctly returned because they are defective, unsafe, damaged in transit, incomplete or not the goods ordered.
Pre-owned and vintage goods may show age-related wear. A disclosed mark, box defect, missing item or other stated condition issue is part of the agreed product condition and is not treated as an undisclosed defect.
We will not use a condition description to exclude liability for a material defect that was not disclosed or a right that the Consumer Protection Act protects.

Approved refunds will normally be made through the original payment method. Refunds will be processed within the period required by law, subject to any payment-provider processing time.
Original delivery charges and return costs will be refunded where the law requires it or where the return resulted from our error. For a cooling-off return without a defect, you may be responsible for the direct return cost.
A promotion or discount code is subject to its stated dates, stock limits and product exclusions. Unless the promotion says otherwise, codes may not be combined, exchanged for cash or applied after an order is placed.
A promotion does not remove any statutory consumer right.
You may not misuse the website, attempt unauthorised access, introduce harmful code, interfere with the checkout, scrape the catalogue at scale without permission, or use the site for unlawful activity.
We may suspend an account or block access where reasonably necessary to protect customers, the website, payment systems or legal rights.
The Model Cars for Africa name, website design, original written content, graphics and original photographs belong to us or are used with permission. Manufacturer names, vehicle names, logos and product marks belong to their respective owners.
You may use the website for personal shopping and reference. You may not reproduce or commercially use website content without written permission or another lawful basis.
The website may link to BobShop, Model Mania 64, social-media pages, payment services or other third-party websites. Their content, availability, terms and privacy practices are controlled by those third parties.
We do not exclude liability for fraud, gross negligence, unsafe or defective goods, breach of a statutory duty, or any liability that South African law does not allow us to exclude.
Subject to those rights, we are not responsible for an indirect loss that was not reasonably foreseeable when the order was accepted, or for loss caused by customer misuse, unauthorised modification, incorrect delivery information or an event outside our reasonable control.
Send a complaint to sales@modelcarsforafrica.co.za with your order number, contact details and a clear description of the issue. We will try to resolve the complaint directly and will respond as soon as reasonably possible.
If the complaint remains unresolved, a consumer may contact the Consumer Goods and Services Ombud through www.cgso.org.za or approach another body with legal authority, including the National Consumer Commission.
We may update these terms when our business, website or legal duties change. The version shown when an order is placed will govern that order unless the law requires a different result.
South African law governs these terms. A dispute may be brought before a court, ombud, regulator or tribunal with lawful jurisdiction.
